How Do I Prove I Have a Case?

Considering the complexity of medications and the laws regulating them, it’s no surprise that many people aren’t sure whether or not they have a case. Proving that a drug was defective involves three basic steps:

  1. First, you will need to prove you are injured, usually with medical records. While this might sound simple, it means that if you were prescribed or given the wrong drug but noticed before taking it, then you're unlikely to win your case.

  2. Second, you will need to prove that the drug was defective in one of three ways:

    • False Marketing — if the drug’s warning label or symptom list are incomplete or inaccurate, then the drug has been improperly marketed.

    • Dangerous Side Effects — if the drug company concealed dangerous side effects from consumers or failed to catch those side effects during testing, you may have a case.

    • Faulty Manufacturing — these cases involve drugs that are impure, expired, or mislabeled.

  3. Third, and finally, you will need to prove that the drug’s defect caused your injury. Proving this claim is likely to require detailed medical documentation, expert testimony, and other sorts of specific evidence.

Elmiron

Side effect: Vision loss

This medication is used to treat pain and discomfort from a certain bladder disorder (interstitial cystitis). It may work by forming a layer on the bladder wall and protecting it from harmful or irritating substances in the urine. It is also a weak "blood thinner" and therefore may increase the risk of bruising/bleeding (e.g., bleeding from the nose/gums).

Losartan

Side effect: Cancer

In November 2018, the FDA issued a recall of Losartan after detecting trace amounts of the probable human carcinogen, N-nitrosodiethylamine (NDEA). This is the third blood pressure drug to have been recalled due to possible cancer risk.

Many patients that were on Valsartan were switched over to Losartan after Valsartan was recalled in July 2018. However, these Losartan users are still at risk of contamination.

Taxotere

Side effect: Alopecia (permanent hair loss)

Taxotere (docetaxel) is a cancer medication that interferes with the growth and spread of cancer cells in the body. Taxotere is typically used to treat breast cancer, lung cancer, prostate cancer, stomach cancer, and head/neck cancers.

Taxotere is administered intravenously through a vein and is a member of a family of drugs called taxanes. Many have found there are serious problems and devastating potential side effects caused through the use of Taxotere.

Uloric

Side effects: Heart attack, stroke, cardiovascular issues

Uloric is a prescription medication used to treat people suffering from gout. Uloric was first put on the market in the United States in February of 2009. The drug company that developed and sold Uloric is Takeda Pharmaceuticals.

When Uloric was first put on the market, Takeda Pharmaceuticals did not warn doctors or their patients that Uloric could cause an increased risk of a heart attack, stroke, other cardiovascular problems, and even death.

Xeljanz

Side effect: Blood Clots

Xeljanz and Xeljanz XR (tofacitinib) are oral medications manufactured by Pfizer and approved for the treatment of adults with Rheumatoid arthritis (RA), Psoriatic arthritis (PSA), and Ulcerative colitis (UC).

Xeljanz and Xeljanz XR belong to a class of drugs called Janus kinase (JAK) inhibitors, which can decrease activity in the immune system.

Zantac

Side effect: Cancer

Ranitidine, which is sold under the trade name Zantac, is a medication that decreases stomach acid production. It is commonly used in the treatment of peptic ulcer disease, gastroesophageal reflux disease (GERD), and Zollinger–Ellison syndrome. There is also tentative evidence of benefit for hives. It can be taken by mouth, by injection into a muscle, or into a vein.

Common side effects include headaches, pain, or burning if given by injection. Serious side effects may include liver problems, a slowed heart rate, pneumonia, and the potential of masking stomach cancer. It is also linked to an increased risk of Clostridium difficile colitis. Ranitidine is an H2 histamine receptor antagonist that works by blocking histamine, and thus decreasing the amount of acid released by cells of the stomach.
